Why you need an LPA

A Lasting Power of Attorney is not just for those who are older and illnesses begin to impact mental capacity. – it is important for everyone as we never know when something can happen that impacts you and your family.

A Lasting Power of Attorney:

  • Helps by allowing you to choose who you want to act on your behalf to make financial, property, health or well being decisions when you want it or when you no longer have capacity to make decisions.  If you don’t have one the Court of Protection will appoint a deputy ion your behalf.

If you don’t make a lasting power of attorney (LPA), you won’t able to legally make decisions for yourself if you lose mental capacity. This can lead to a number of issues, including: 
  • Family members can’t make decisions
    Family members may not be able to pay bills or make decisions about your care. 
     
  • Court of Protection may appoint a deputy
    Someone may need to apply to the Court of Protection to be appointed as your deputy. This can be a lengthy and expensive process, and you can’t choose who your deputy is. 
     
     
  • Healthcare professionals make decisions
    Healthcare professionals will make decisions for you based on what they believe is in your best interests. They will consider your wishes and feelings, but they will make the final decision.

In order to write a Lasting Power of Attorney you need to have mental capacity.

The law defines Mental capacity in the Mental Capacity Act 2005.

In common sense parlance it is determined by whether in communication, speech, writing, signs or another way you understand the

But in a nutshell it’s determined by whether you’re able to understand the following when you’re making a decision: – The decision you need to make – Why you need to make it – Any relevant information that helps inform the decision – The consequences of your decisions – And that you’re able to communicate the above (whether that’s through speech, signs or another way).

 

Someone needs to assess you as having Mental capacity this person is called the “Certificate Provider”.

 

There are two costs to an LPA.

1. The first is the drafting of an LPA.

  • You can draft your own LPA for free by going to the Court of Protection website. Our FAQs provide the categories needed to complete their forms

2. the second cost is Registration of an LPA.
